Gwinnett County will not prosecute anyone arrested for distributing beverages or food to voters waiting in line at polls.
The announcement comes on the heels of Gov. Brian Kemp signing Georgia’s election reform bill into law. The legislation makes it illegal for volunteer groups to hand out water to voters waiting in line at polls. Kemp has said poll workers and nonpartisan groups will be allowed to hand out water, but not partisan groups who are trying to persuade voters on election day.
Gwinnett County Solicitor General Brian Whiteside said Monday that his office would not prosecute the offense.
“The Gwinnett County Solicitor’s Office will not prosecute individuals arrested for distributing nonpartisan beverages and/or food to voters waiting in line for long hours on Election Day in Gwinnett County as there is no rational, legal basis for this law,” Whiteside said.
Whiteside has previously vowed to sue the state if the voting reform bill became law.
