{"id":39732,"date":"2022-08-23T17:53:00","date_gmt":"2022-08-23T21:53:00","guid":{"rendered":"http:\/\/capitol-beat.org\/?p=7882"},"modified":"2022-08-23T21:04:37","modified_gmt":"2022-08-24T01:04:37","slug":"georgia-supreme-court-orders-lower-court-to-reconsider-foster-care-vaccination-case","status":"publish","type":"post","link":"https:\/\/thegeorgiasun.com\/?p=39732","title":{"rendered":"Georgia Supreme Court orders lower court to reconsider foster care vaccination case"},"content":{"rendered":"\n<p>A juvenile court must reevaluate the sincerity of parents\u2019 objections to their children\u2019s vaccinations, the state Supreme Court ruled Tuesday. &nbsp;<\/p>\n\n\n\n<p>At issue is whether children in temporary state custody can be immunized with routine childhood vaccines over their parents\u2019 religious objections \u2013 and how to decide if those objections are sincere or not. &nbsp;<\/p>\n\n\n\n<p>The three young children in this case (now ages 2, 4, and 6) were removed from their parents\u2019 care last year due to the father\u2019s alleged violence. The removal was temporary, with a plan in place to reunify the family after the parents met certain conditions. &nbsp;<\/p>\n\n\n\n<p>When the parents learned of the state <a href=\"\/tag\/foster-care\/\" title=\"foster care\">foster care<\/a> agency\u2019s plans to have the children immunized, they asked a Forsyth County Juvenile Court judge to stop the state from going forward, citing religious and philosophical objections to immunization. &nbsp;<\/p>\n\n\n\n<p>The state argued the children needed the immunizations to facilitate their foster care placement, education, and <a href=\"\/2022\/07\/21\/one-of-georgias-lowest-ranked-counties-for-health-care-is-getting-a-new-health-center\/\" title=\"One of Georgia\u2019s lowest ranked counties for health care is getting a new health center\">health care<\/a>. &nbsp;<\/p>\n\n\n\n<p>The juvenile court judge denied the parents\u2019 request, finding their religious objections insincere. The parents failed to regularly attend church, lacked association with a \u201cparticular religion,\u201d and held secular objections to vaccination, the judge said. &nbsp;<\/p>\n\n\n\n<p>On Tuesday, the state Supreme Court ruled unanimously that the juvenile court applied the wrong standards for evaluating the sincerity of the parents\u2019 objections to immunization. &nbsp;<\/p>\n\n\n\n<p>The case will now be returned to the juvenile court for another look using the new guidance. &nbsp;<\/p>\n\n\n\n<p>When the juvenile court weighs the parents\u2019 sincerity, it should use a \u201clight judicial touch,\u201d wrote Supreme Court Presiding Justice Nels S.D. Peterson. &nbsp;<\/p>\n\n\n\n<p>Peterson provided some factors the lower court could consider when deciding whether the parents\u2019 religious objections were \u201ctruly held.\u201d&nbsp;<\/p>\n\n\n\n<p>These included length of religious belief, amount of knowledge, reliance on religious texts and teachings, and \u201cwhether [the parents] have wavered in their actions related to vaccination.\u201d &nbsp;<\/p>\n\n\n\n<p>The state Department of Human Services (DHS), which oversees foster care, changed its policy on parents\u2019 objections to vaccination while this case was pending.&nbsp;<\/p>\n\n\n\n<p>DHS Commissioner Candice Broce sent a memo June 1 directing employees not to seek immunizations for any child in temporary custody if the child\u2019s parents hold a sincere religious objection.&nbsp;<\/p>\n\n\n\n<p>Lawyers for the agency asked the Supreme Court to dismiss the case, saying the new policy made the case moot.
